Please review these policies carefully before placing an order or requesting services.
General Firearm Sales
All firearms, magazines, receivers, and restricted law enforcement items are sold and shipped in accordance with all applicable federal, state, and local laws. Certain items may be restricted or prohibited in your area. It is the customer’s responsibility to verify legality before ordering.
All new firearms are shipped in the original manufacturer’s packaging with included accessories and applicable warranties. Firearm sales are final. Firearms requiring warranty service must be returned to the manufacturer within one (1) year of purchase.
Accessories and special-order items not normally stocked by Torchwood Tactical, LLC are not covered under warranty unless explicitly guaranteed in writing. Customers should contact the original manufacturer for warranty service on accessories.
Purchasing Firearms Online
Federal law prohibits shipment of firearms directly to individuals who do not hold a valid Federal Firearms License (FFL). Firearms purchased online may be picked up at our location or shipped to a customer-selected FFL.
Torchwood Tactical, LLC may contact and verify the receiving FFL before shipment. Customers are strongly encouraged to contact the receiving FFL before placing an order.
Unclaimed and Abandoned Firearms
Torchwood Tactical, LLC must approve all incoming firearm transfers before a firearm is shipped. By purchasing a firearm for delivery to Torchwood Tactical, LLC, directing a firearm to be shipped to Torchwood Tactical, LLC, or otherwise selecting Torchwood Tactical, LLC as the receiving FFL, the customer acknowledges and agrees to this policy.
Transfer Fees
The applicable transfer fee becomes due when the firearm is received, processed, secured, and entered into the required federal acquisition and disposition records of Torchwood Tactical, LLC.
The transfer fee remains due regardless of whether the customer completes the transfer, cancels the transaction, fails to retrieve the firearm, is denied or delayed during the background-check process, becomes legally ineligible to receive the firearm, or requests that the firearm be returned.
Customer Notification
Torchwood Tactical, LLC will make reasonable efforts to notify the customer when the firearm has been received and is available for transfer. Notice may be provided by telephone, voicemail, text message, email, or mail using the contact information provided by the customer, seller, or shipping FFL.
The customer is responsible for providing accurate contact information and promptly notifying Torchwood Tactical, LLC of any changes.
Initial Pickup Period and Storage Fees
The customer has thirty (30) calendar days from the date of the first notification to complete the transfer without incurring storage fees. The initial thirty-day period does not waive or postpone payment of the applicable transfer fee.
Beginning on the thirty-first (31st) calendar day following the first notification, a storage fee of $5.00 per firearm, per calendar day will accrue.
Storage fees will continue to accrue until the firearm is lawfully transferred to the customer, returned to the original seller or shipping FFL, transferred to another willing FFL, deemed abandoned under this policy, or otherwise lawfully disposed of.
Return of a Firearm
If a customer does not or cannot complete the transfer, the customer may request that the firearm be returned to the original seller or shipping FFL. Torchwood Tactical, LLC will not ship a firearm directly to the customer or another unlicensed person.
The customer is responsible for all costs associated with returning the firearm, including:
- The unpaid transfer fee
- Accrued storage fees
- Shipping expenses
- Shipping insurance
- Packaging and handling expenses
- Carrier-imposed charges
- Receiving-dealer charges
- Any other reasonable expenses associated with the return
The firearm will not be shipped until the receiving FFL has been verified and all applicable charges have been paid. Torchwood Tactical, LLC is not responsible if the original seller or shipping FFL refuses to accept the firearm.
Failure or Refusal to Pay Return Expenses
A customer will be considered to have failed or refused to pay return expenses when the customer:
- Expressly refuses to pay the required charges
- Fails to pay the required charges by the stated deadline
- Does not respond to return instructions or payment requests
- Does not provide a willing receiving FFL
- Disputes or reverses payment for transfer or return expenses
- Otherwise prevents Torchwood Tactical, LLC from completing the return
Abandonment of a Firearm
A firearm will be considered unclaimed and abandoned when all of the following conditions have been satisfied:
- The firearm has been received and entered into the records of Torchwood Tactical, LLC
- The applicable transfer fee has not been paid
- The customer has failed or refused to complete the lawful transfer
- The customer has failed or refused to pay the expenses required to return the firearm
- Either ninety (90) calendar days have elapsed since the first notification, or the unpaid transfer fee, accrued storage fees, shipping costs, handling expenses, and other authorized charges equal or exceed the reasonably determined fair market value of the firearm, whichever occurs first
Final Abandonment Notice
Before claiming ownership of an abandoned firearm, Torchwood Tactical, LLC will make a final reasonable effort to notify the customer using the customer’s last known email address, telephone number, or mailing address. When a valid mailing address is available, the final notice may be sent by certified mail.
The final notice will provide the customer with at least fifteen (15) calendar days to take one of the following actions:
- Pay all applicable charges and complete the lawful transfer
- Pay all applicable charges and arrange for return to the original seller or shipping FFL
- Pay all applicable charges and arrange for transfer to another willing FFL
Failure to respond to or comply with the final abandonment notice within the stated period will constitute confirmation that the customer has abandoned the firearm and relinquished all ownership interests in it.
Relinquishment of Ownership
By agreeing to this policy, the customer expressly agrees that a firearm meeting the abandonment conditions described above is voluntarily and permanently abandoned.
Upon expiration of the final notice period, the customer:
- Irrevocably relinquishes and surrenders all right, title, ownership, possessory interest, and claim to the firearm
- Authorizes Torchwood Tactical, LLC to take ownership and possession of the firearm
- Agrees that the firearm will become the sole property of Torchwood Tactical, LLC
- Authorizes Torchwood Tactical, LLC to retain, sell, transfer, trade, consign, or otherwise lawfully dispose of the firearm
- Waives any claim to the firearm or to any proceeds obtained from its subsequent sale or disposition
- Releases Torchwood Tactical, LLC and its owners, employees, and agents from claims arising from the lawful retention, sale, transfer, or disposition of the firearm
Determination of Fair Market Value
Torchwood Tactical, LLC may determine a firearm’s fair market value using reasonably available information, including:
- The customer’s purchase receipt
- The seller’s invoice
- Manufacturer information
- Current retail prices
- Current used-firearm prices
- The firearm’s condition
- Completed sales of comparable firearms
- Dealer or auction estimates
- Damage, defects, missing components, or other conditions affecting value
Fair market value will be based on the estimated value of the firearm at the time the abandonment determination is made and may differ from the amount originally paid by the customer.
Denied or Prohibited Customers
A firearm will not be transferred to a person who is prohibited by law from receiving or possessing it or whose transfer is denied. A denial, prohibition, cancellation, or inability to complete the transfer does not eliminate the customer’s responsibility for transfer fees, storage fees, return shipping, or other applicable expenses.
A firearm will not be released to a family member, friend, agent, representative, or other third party unless that person may lawfully receive the firearm and completes all required transfer procedures.
Federal and State Compliance
Any subsequent sale, transfer, return, or disposition of an abandoned firearm will be completed in accordance with applicable federal, state, and local laws. All acquisitions and dispositions will be recorded as required by federal law.
Nothing in this policy authorizes the release or transfer of a firearm without required federal firearms records, background checks, licensing requirements, or other legally required procedures.
National Firearms Act Items
This abandonment policy does not independently authorize the transfer, registration, sale, or disposition of a firearm regulated under the National Firearms Act. Any National Firearms Act item remains subject to all applicable ATF approval, registration, transfer, tax, and recordkeeping requirements.
Changing, Modifying, or Substituting Orders
If an order requires modification, it will be canceled and refunded in full minus a $10 administrative fee, issued as a gift card. Once refunded, the customer may place a new order.
Torchwood Tactical, LLC will not place orders on behalf of customers due to fraud prevention and sensitive transaction information. All lead times restart once a new order is placed.
Returns & Canceled Orders
All canceled and returned orders are subject to a 25% restocking fee. All sales are final, including firearms, ammunition, and optics.
Orders exceeding twenty-one (21) days without receipt of required documentation will be canceled and refunded minus the 25% restocking fee.
Order Fulfillment
Orders ship within 3 to 10 business days from distributor warehouses or in-store inventory using UPS, FedEx, or USPS. Tracking is provided when available.
- Flat-rate shipping applies to the lower 48 states only
- No international or non-lower-48 shipping
- Billing and shipping addresses must match or orders may be flagged as fraud
- Serialized items are shipped only to the designated FFL
- Do not list the FFL as the shipping address
Ammunition Purchases
- Customers must be at least 18 years old to purchase rifle or shotgun ammunition
- Customers must be at least 21 years old to purchase handgun ammunition
- An adult signature is required upon delivery
- All ammunition sales are final
Customers are responsible for verifying correct ammunition use and compliance with all applicable laws.
Affidavit of Customer
By placing an order or requesting firearm-related services, the customer represents that:
- I am not an unlawful user of or addicted to controlled substances
- I am not prohibited from purchasing firearms or ammunition
- I am not under indictment or subject to a disqualifying restraining order
- I have not been convicted of a disqualifying crime
- I meet all applicable federal, state, and local age requirements
- I have not renounced United States citizenship
Indemnification & Agreement to Defend
By placing an order, you agree to indemnify, defend, and hold harmless Torchwood Tactical, LLC and its affiliates from any liability arising from inaccurate representations or failure to comply with these terms.
Class Action Waiver
All disputes shall be resolved on an individual basis only. You waive any right to participate in class, consolidated, or representative actions.
Trademarks & Copyright
All trademarks, content, graphics, logos, and materials on this website are the exclusive property of Torchwood Tactical, LLC and are protected under United States and international copyright laws.
Limitation of Liability
This website and its contents are provided “as is.” Torchwood Tactical, LLC disclaims all warranties and is not liable for damages arising from use of this site.
Applicable Law & Policy Changes
These policies are governed by the laws of the State of North Carolina. Torchwood Tactical, LLC reserves the right to update these policies at any time.
The policies posted on this page are current and remain effective until revised by Torchwood Tactical, LLC.
